Terms and Conditions
This Terms and Conditions Agreement (the “Agreement”) sets forth the legally binding terms and conditions for your use of the ​Motiver app, software applications, and any other products and services (collectively, the “Services”). The terms “we,” “us,” and “our” as used in this Agreement refer to Motiver Pte Ltd. By using the Services, you (the “User”) agree to and accept the terms of this Agreement. If you do not agree to or accept the terms of this Agreement, you should immediately cease using the Services.
Motiver (“we,” “us,” “our,” “​Motiver,” etc.) owns and operates the ​Motiver mobile applications and related websites (collectively, our “Site”), on which we provide a service that enables users to earn and redeem rewards. Your use of the Service is subject to the terms and conditions set forth in this Agreement – Terms of Service (this “Agreement” or these “Terms”). These Terms govern your use of the Service whether or not you are a registered user.
IF YOU DO NOT AGREE WITH THESE TERMS, DO NOT USE THE SERVICE. WE RESERVE THE RIGHT TO MAKE CHANGES TO THESE TERMS AT ANY TIME, WHEREOF WE WILL PROVIDE NOTICE ON THE SITE. YOUR CONTINUED USE OF OUR SERVICE THEREAFTER CONSTITUTES YOUR ACCEPTANCE OF THE REVISED TERMS.
GENERAL PROVISIONS
These Terms shall be interpreted in accordance with the laws of Singapore without reference to conflict of law principles. With respect to specific transactions between or among certain users, the laws of other jurisdictions may apply. These Terms contain the entire understanding between you and us regarding the subject matter hereof, and supersede all prior and contemporaneous agreements and understandings.
No failure or delay by a party in exercising any right, power, or privilege under these Terms shall operate as a waiver thereof. This Agreement may be assigned by us to any third party, but you may not assign this Agreement or any of your rights or obligations hereunder without our express written consent. If any provision hereof is found to be invalid or unenforceable, such provision shall be recast to the extent required to make it valid and enforceable, and the other provisions hereof shall be unaffected thereby.
MINORS
Our Service is intended for persons having the legal capacity to be bound by these Terms, or acting with the express or implied consent of their parent or legal guardian. By using our Service, you represent and warrant that
(i) you are over 18 years of age; and,
(ii) that you have the right, authority, and capacity to accept these Terms and abide by all of the terms and conditions set forth herein. Children younger than 18 years of age may not register as a parent profile or account and use the Service under any circumstances. In addition, you may not use the Service to track the whereabouts or activities of any child without first informing them about the service. You agree and warrant that you will not use ​Motiver to monitor your children of 18 years and above.
REGISTRATION
In order to use the Service, you must register an account. In order to register, you must be at least 18 years old and a resident of a jurisdiction where the Service can lawfully be provided. You agree to provide accurate and complete registration information. You are responsible for all activities that occur under your account. You are responsible for maintaining the confidentiality of your account password and for restricting access to your account, and you agree to accept responsibility for all activities that occur under your account. You may only create one account and you must not use another person’s account without their permission. You agree to immediately notify us of any unauthorized use, or suspected unauthorized use of your account or any other breach of security. We will not be liable for any loss or damage arising from your failure to comply with the above requirements.
LICENSE
We hereby grant you a personal, non-exclusive, revocable license to download and install our Service on your device, subject to the Terms of this Agreement. You may not:
(i) transfer or sublicense the Service to anyone else;
(ii) copy, modify, or distribute our Service;
(iii) reverse engineer, decompile, or create derivative works of the Service;
(iv) use more than one account per individual;
(v) use the Service in any unlawful manner or in a manner inconsistent with these Terms.
INFORMATION LOGGING
Motiver does not collect any information or log data from the mobile device or computer from which it is being used except for the user’s personal information, including the name and email address, which the user has consented to being logged. ​Motiver does not collect information like call history, contacts, browser history, installed apps, and location details from the Parents App. If you think we have unwillingly collected such information, please notify us immediately at support@motiver.ai.
WARRANTIES
To use ​Motiver, you warrant that:
- You are 18 years of age or older.
- You will not use the Site or Service in violation of any Federal, State, or local law, rule, ordinance, or governmental regulation.
- You will only use the Site and Service for lawful purposes.
- You will properly follow all instructions and documentation provided by ​Motiver.
- You will not allow any other person to access the information that the Site and Service collect from the mobile devices on which the Software is installed.
- You will only install the application on mobile devices for which you are the authorized owner.
USER IDENTITY
You may not create or use an account on the Service for anyone other than yourself. You may not let others use your account and you may not share your login information with others. You must keep your contact and personal profile information accurate and current. We will only disclose your identity to third parties in accordance with our Privacy Policy. You may never use another User’s account without permission.
When creating your account, you must provide accurate and complete information. You are solely responsible for the activity that occurs on your account, and you must keep your account password secure. We encourage you to use “strong” passwords (passwords that use a combination of upper and lower case letters, numbers, and symbols) with your account. You must notify us immediately of any breach of security or unauthorized use of your account. We will not be liable for any losses caused by any unauthorized use of your account.
GENERAL USER CONDUCT
You are solely responsible for all media and content you upload to the Site, including without limitation ensuring the veracity thereof and obtaining the legal permission to so disclose such content. Your uploading of all such content must be in compliance with applicable law and all applicable provisions hereof. Such content shall not be hateful, threatening, obscene, unprofessional, or posted for purposes other than in furtherance of the Service. We may refuse Service to you for any lawful reason or for no reason.
You agree to use our Service responsibly, with good judgment, and in a manner conforming at minimum to prevailing standards for Internet and business etiquette. For example, and without limitation, while using the Service you shall not:
(a) violate any applicable law or regulation;
(b) infringe the rights of us or any third party, including without limitation intellectual property, privacy, and contractual rights;
(c) use information obtained through our Service for any unauthorized purpose;
(d) interfere with or damage our Service, including without limitation through the use of viruses, bots, Trojan horses, harmful code, flood pings, denial of service attacks, packet or IP spoofing, forged routing, forged electronic mail address information, means to reproduce or circumvent the navigational structure or presentation of the Service or its contents, or similar methods or technology;
(e) use our Service unlawfully to transmit, distribute, post, or submit any private information concerning any other person or entity, including without limitation photographs, personal contact information, or numbers of credit, debit, or calling cards or accounts;
(f) use our Service in connection with the distribution of unsolicited commercial email or advertisements;
(g) use our Service to stalk, harass, or track the whereabouts or activities of any other individual without the individual’s knowledge or consent;
(h) collect any information about any other user other than as customarily arises in the course of permitted use of our Service;
(i) use our Service for any unauthorized commercial purpose;
(j) impersonate any person or entity;
(k) remove any copyright, trademark, or other proprietary right notices or legends contained in the Service;
(l) modify, adapt, sublicense, translate, sell, reverse engineer, decipher, decompile, or otherwise disassemble any portion of the Service or our Site or any software used on or for the Service;
(m) collect or compile information from our Site using any manual or automated means; or
(n) assist or facilitate any third party in doing any of the foregoing.
Furthermore, you may not use the Site or Service to develop, generate, transmit, or store information that:
(i) is defamatory, harmful, abusive, obscene, or hateful;
(ii) in any way obstructs or otherwise interferes with the normal performance of another person’s use of the Site and/or Service;
(iii) performs any unsolicited commercial communication not permitted by applicable law;
(iv) constitutes harassment or a violation of privacy or threatens other people or groups of people;
(v) is harmful to children in any manner;
(vi) violates any applicable law, regulation, or ordinance;
(vii) makes any false, misleading, or deceptive statement or representation regarding us and/or the Site or Service; or
(viii) constitutes phishing, pharming, or impersonates any other person, or steals or assumes any person’s identity (whether a real identity or online nickname or alias).
USAGE OF AI TECHNOLOGY
By using Motiver’s AI features, you agree that the AI will analyze interactions such as task completions, behavioral patterns, and conversations to provide personalized content, including:
AI-powered mood detection to monitor emotional well-being.
AI-generated bedtime stories tailored to the child's mood and age.
Parental reports generated through AI-driven insights on behavior and task management.
PARENTAL CONTROL AND RESPONSIBILITY
Legal Guardian Requirement: To add and manage a child in your profile, you must be the legal guardian.
Informed Consent: You must inform your child and obtain their consent before using Motiver’s services to track them.
AI Usage: Parents retain full control over the use of Motiver’s AI features. The data, insights, and reports generated by the AI are accessible only to authorized users. Parents are responsible for ensuring proper usage of the AI features.
Adult Consent: Motiver services should never be used to track any adult without their written consent.
Family Group Access: Motiver allows parents to invite other adults to view and manage their child’s profile within the family group. Granting access to these adults is solely the responsibility of the account owner, and they must ensure that invited adults use the platform responsibly.
FAIR USAGE POLICY
To maintain optimal performance and fairness, Motiver enforces the following fair usage policies:
AI Voice Interaction Limit: The AI voice assistant is limited to 180 minutes of interaction per day / child to ensure balanced usage.
Personal Use Only: Motiver’s AI features are strictly for personal use and are not intended for commercial purposes.
Overuse and Misuse: Any abuse of the AI features, including exceeding daily limits or attempting to use the system for non-intended purposes, may result in suspension or restriction of access.
LIMITATIONS OF AI RECOMMENDATIONS
While Motiver’s AI provides valuable insights, it is not a substitute for professional psychological or medical advice. We encourage parents to seek professional assistance when necessary for their child’s mental and emotional health.
MODIFICATIONS AND UPDATES
We may periodically update and improve our AI technology to ensure the best user experience. By continuing to use Motiver, you agree to comply with these terms and any future updates.
DISCLAIMER OF LIABILITY
AI Detection Accuracy: While we strive for excellence but errors may occur. Motiver's AI detection services may not be 100% accurate. We provide a feedback mechanism for AI generated content, allowing you to submit suggestions for improvement.
No Behavioral Guarantees: Motiver does not guarantee a change in your child's behavior. Our tools are designed to assist with organizing and managing your child's activities, but outcomes depend on various factors, including individual circumstances and usage.
Parental Involvement: Effective use of Motiver requires active parental involvement and consistent reinforcement of desired behaviors.
No Professional Advice: Motiver's content and services do not constitute professional advice, including psychological, educational, or medical guidance. Consult qualified professionals for personalized advice.
Service Downtime: We strive to keep the app functioning smoothly at all times, ensuring you have a seamless experience. However, there may be instances where the app or certain features experience downtime or may not work accurately. If you are on a paid membership, please note that no refunds or extensions of the subscription period will be provided due to these service interruptions. We appreciate your understanding and support.
DATA COLLECTION AND PRIVACY
Motiver’s AI requires certain data inputs, including:
Interactions with tasks and activities.
Engagement levels and mood insights gathered through AI interactions.
All collected data is securely handled as per our Privacy Policy, and it is used only to improve the experience for both parents and children.
We respect your privacy during your use of our Service. Use of the Service is governed by our Privacy Policy.
MOBILE SOFTWARE
We make available software to access the Service via a mobile device (“Mobile Software”). To use the Mobile Software, you must have a mobile device that is compatible with the Mobile Service. We do not warrant that the Mobile Software will be compatible with your mobile device. For details, please read our App Privacy Policy.
COOKIES AND OTHER TRACKING TECHNOLOGIES
"Cookies" are small bits of electronic information that a website sends to a visitor's browser and are stored on the visitor's hard drive.
